The patent team at One Law Partners represented company ‘R’ that received a warning letter on infringement of registered trademark with respect to company names and websites, and won a case that involved 3 instances of trademark registration invalidation.

The circumstances were rather unfavorable to company ‘R’ as the Tribunal already issued a judgment that all 3 registered trademarks were valid. However, the patent team pointed out one by one the mistakes in the Tribunal’s judgment with respect to the determination of separation observation and similarity, and was able to reverse all of the trial decisions of the Tribunal in the Patent Court. ​

We view that the success was due to our submission of various materials related to the idea that the general business entity would call the registered trademark and the preceding registered trademark similarly. Subsequently, the appeals of the trademark owner were all dismissed at the Supreme Court, and therefore the invalidation of the 3 registered trademarks was confirmed.
